Excellent Product Designation System
What is Excellent Product Designation?
Introduced in 1996 to improve the quality of procurement goods, this system designates products with outstanding
technology and quality among those manufactured by small and medium-sized enterprises (SMEs)
as "Excellent Products" through a rigorous evaluation process.

Legal Basis for Excellent Product Designation
Article 26 of the "Act on Facilitation of Procurement" and Article 30 of its Enforcement Decree.
Article 7 of the "Act on Contracts to Which the State is a Party" and Article 26, Paragraph 1, Subparagraph
3 (f) of its Enforcement Decree, etc.
Third-Party Contracts
In cases where a negotiated contract (private contract) is concluded in accordance with Article 26 of the
"Enforcement Decree of the Act on Contracts to Which the State is a Party" or Article 25 of the "Enforcement Decree of the
Act on Contracts to Which the Local Government is a Party," a third-party unit price contract or a total amount
contract may be concluded.
Exemption System for Purchasing Managers of Public Institutions
Article 14, Paragraph 3 of the "Act on the Promotion of Purchase of Small and Medium Enterprise Products and Support
for Development of Market Platforms."
The person in charge of purchasing at a public institution who has entered into a contract to purchase a technology
development product subject to preferential purchase shall not be held liable for any loss resulting
from the purchase of that product, unless intent or gross negligence is proven.
